Sacramento Resident Rear-Ended In Auto Accident, Part 3 of 6

The following blog entry is written from a defendant’s position as trial approaches. Reviewing this kind of briefing should help potential plaintiffs and clients better understand how parties in personal injury cases present such issues to the court.

Plaintiff next sought physical therapy treatment from NeuroActivity Rehab of Roseville. She received an initial evaluation on June 14, 2005 and continued to receive treatment through September 15, 2005, for a total of five treatment sessions.

A June 14, 2005, NeuroActivity Patient Intake Form indicates diagnosis was scoliosis and DOI: 2 weeks.

The NeuroActivity treatment notes document that between the initial evaluation of 6/14/06 and final treatment note of 9/27/06, there were six “no shows” and one cancellation by the plaintiff.

The NeuroActivity June 14, 2005 evaluation indicates diagnosis was scoliosis/lumbosacral strain. Plaintiff reported the 2/7/06 motor vehicle accident. She said three days later she felt low back pain which had gone away and then came back one month later. She had not had any x-rays. It was noted she worked in customer service at Macy’s. She would have pain while lying on her back. She was to start next week at Community. Assessment was lumbar-hip dysfunction with tight muscles.

On July 7, 2005 she reported she was sore after treatment. She had some continued low back pain but no so intense. She was sporadic with her home stretches.

On September 15, 2005 she had a further evaluation at NeuroActivity. Pain had increased recently after a lot of walking in Paris . Assessment was hip-pubic dysfunction.

Plaintiff returned to Dr. Wong on September 13, 2005. She was reporting right ankle pain, left wrist pain, and neck pain in the joints and she also had lower back pain. She had a dry throat and headaches. It was noted she had gone to Paris for 2 weeks with her mother. She apparently started coughing in the shower. She was very tired recently. Her boss was also tired and there was a question of mono . She reported right ankle joint pain and low back pain which she reported was still there since the accident. Assessment was mono-like syndrome with fatigue, arthralgias. She was to take fluids and Advil. She was also diagnosed with low back pain due to motor vehicle accident and she was to continue with physical therapy and/or use chiropractic.

Plaintiff returned to Dr. Wong on October 10, 2005. She reported she was still having low back pain. Her legs would hurt occasionally but she had no neurological symptoms. It was recommended she try chiropractic treatment for her low back pain.

Plaintiff, in fact, finally did start chiropractic treatment, from John Black, D.C. of Sacramento. Treatment began on October 12, 2005 which was approximately nine months post-accident.

According to billing records, she continued to receive treatment through at least February 22, 2008, for a total of 62 treatment sessions. (See Part 4 of 6.)
