Stuart Heinsman was driving a compact car southbound. He entered the traffic circle after passing a yield sign, and the front left of Heinsman’s auto struck the front right of Gertrude’s auto.
Claiming physical damages, Gertrude sued Heinsman for motor vehicle negligence.
Gertrude claimed that Heinsman failed to yield at the yield sign.
Gertrude later underwent a carpal tunnel release to her right wrist and ulnar nerve transposition to her right elbow.
Gertrude claimed that her surgery and other procedures resulted directly from the car accident, claiming medical specials of $70,000.

Gertrude was not working at the time, but she claimed that she planned to return to work.
Gertrude also made an unspecified demand for pain and suffering.
Heinsman disputed the damages, contending that Gertrude’s fusion surgery was the result of a degenerative disc disease, as per her medical records. He also claimed that the carpal tunnel release and ulnar nerve transposition resulted from repetitive motions that she made while working with computers.
Heinsman also claimed that Gertrude did not plan on returning to work.

About one month before trial, the case settled for $410,000.
